Work meeting with documents - representation before authorities
Inspections and authorities

Lawyer for inspections and representation before Romanian authorities

Assistance for individuals and companies during inspections, in correspondence with public bodies and in challenging sanctions.

Representation before authorities and inspection support

An inspection can start without warning and end, the same day, with fines, suspension of activity or referrals to other bodies. How you answer questions, which documents you hand over and what is written in the report all matter for what follows. Having a lawyer present helps set out your obligations and rights clearly.

We assist companies and individuals in their dealings with the Labour Inspectorate (ITM), the tax authority ANAF and its Anti-Fraud Directorate, the General Inspectorate for Immigration (IGI), the Trade Registry, public health and veterinary authorities (DSP, DSV, ANSVSA), the fire safety inspectorate (ISU), the consumer protection authority (ANPC), the Environmental Guard, police and prosecutors, city halls, prefectures and pension offices. We prepare replies to requests, objections to inspection reports and appeals against sanctions.

The most effective step, however, comes before the inspection. Through a legal compliance audit we check employment contracts, records, permits and the documents each authority requires, so that problems can be fixed in time. For employers with foreign staff, we also check work permits and residence rights.

FAQ

Frequently asked questions

Am I entitled to a lawyer during an inspection?

Yes, you can be assisted by a lawyer, which is advisable especially in complex inspections. A lawyer's presence does not prevent the inspection from going ahead and does not amount to a refusal to cooperate. Inspectors must receive the documents requested within the limits of the law, and the lawyer helps you answer correctly and record objections in the inspection documents.

Do I have to sign the report if I disagree with it?

You can sign the report and, at the same time, record your objections in the section provided for them. Your signature confirms receipt and that you have read the report, not that you agree with the findings. Written objections made at the time are useful later in an appeal. Always keep a copy of the document.

How do I challenge a fine imposed after an inspection?

Administrative fines are, as a rule, challenged by an appeal to the district court within a short statutory time limit running from when the report is handed over or served. Some measures, such as suspension decisions or sanctions under special laws, follow different procedures. We check straight away which route applies in your case.

What is a legal compliance audit?

It is a preventive review of the company's documents and procedures against the requirements of a particular authority: employment contracts and registers, documents for foreign workers, health or fire safety permits, consumer information. The result is a list of issues and a concrete plan to fix them before any inspection.
