Criminal defence lawyer: representation at every stage of the case

If you have been summoned by the police or prosecutor, received a court summons or are the victim of a crime, the first decisions matter. We assist you from the first step in the case until the judgment is enforced.

Criminal law and criminal defence

Criminal proceedings follow strict rules and short deadlines. A statement given without preparation, a search carried out without a lawyer present or a preventive measure not challenged in time can shape the entire case. That is why it helps to involve a lawyer as early as possible, ideally from the first summons, while you can still decide what to say and how.

We assist and represent clients as suspects, defendants, injured parties, civil parties or parties with civil liability. We study the file, check whether the evidence and investigative acts are lawful, propose defence evidence and file the requests and objections suited to each stage: criminal investigation, preliminary chamber, first-instance trial and appeals.

We handle cases throughout Romania, including economic crime, offences in public office and corruption cases, where accounting and tax records require careful analysis. Mr. Bocse Marian-Mihaita has rights of audience before all Romanian courts, including in appeals before the higher courts and in international judicial cooperation procedures such as the European arrest warrant.

FAQ

Frequently asked questions

Do I have to give a statement to the police or prosecutor?

Suspects and defendants have the right to remain silent, and silence cannot be used as evidence against them. Sometimes, however, a well-prepared statement helps the defence. The decision should be made once your lawyer knows the accusation and the evidence. If you are called as a witness, the rules are different and you are, in principle, required to tell the truth, subject to the exceptions set by law.

What can be done if a relative is held in pre-trial detention?

The decision ordering pre-trial detention can be challenged within a very short deadline set by the Code of Criminal Procedure. Later, requests can be made to revoke the measure or replace it with a lighter one, such as judicial control or house arrest. Contact a lawyer immediately, because these deadlines are counted in days.

Does a crime victim need a lawyer?

It is not mandatory, but it helps. The injured party must join the case as a civil party before a certain stage of the proceedings, prove the loss and follow the prosecutor's decision. For some offences, such as assault or threats, a prior complaint must be filed within the legal deadline, otherwise the matter can no longer be investigated.

What is a plea agreement?

It is an agreement between the prosecutor and the defendant, made during the investigation, in which the defendant admits the offence and the penalty is reduced within legal limits. The court must then approve it. It is not right for every case: where the evidence is weak, a full defence may be the better option. We review the benefits and consequences with you, including the effect on your criminal record.
